Terms of Service

1. Introduction
Welcome to Trialist (“we”, “us”, “our”).
Trialist provides a web-based platform for managing sports trials, including player registration, coach administration, communication, and related tools (the “Service”).
By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.
2. Accounts, Roles, and Security
2.1 Account Creation
To use certain features of the Service, you must create an account. Accounts may be created directly or via an invite issued by an organisation using Trialist.
You agree to:
Provide accurate and up-to-date information
Maintain the confidentiality of your login credentials
Use the Service only within the permissions assigned to your role (e.g. admin, head coach, coach)
2.2 Account Security
You are responsible for all activity that occurs under your account. You must notify us immediately if you believe your account has been compromised or accessed without authorisation.
2.3 Role-Based Access
Access to features and data is restricted by role. Attempting to bypass permissions, access unauthorised data, or interfere with security controls is strictly prohibited.
We may suspend or terminate accounts that breach these Terms or pose a security risk.
3. Subscriptions and Payments
3.1 Billing
Certain features of the Service require a paid subscription. Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan).
3.2 Payment Processing
Payments are processed by Stripe. We do not store full payment card details. By subscribing, you agree to Stripe’s Services Agreement.
3.3 Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. Access continues until that period ends.
3.4 Refunds
Except where required by law, subscription fees are non-refundable.
4. User Data, Trialists, and Responsibility
4.1 Your Data
You retain ownership of all data you upload or submit to the Service, including player information, trial data, and communications (“User Data”).
4.2 Licence
You grant Trialist a non-exclusive, worldwide licence to host, process, transmit, and display User Data solely to provide and improve the Service.
4.3 Responsibility for Player Data
You are responsible for ensuring that:
You have lawful grounds to collect and upload personal data
Appropriate consent has been obtained, including parental or guardian consent where required
Data is accurate and kept up to date
Trialist acts as a platform provider and does not verify the accuracy or legality of User Data.
4.4 Data Protection
We process personal data in accordance with our Privacy Policy, which forms part of these Terms.
5. Acceptable Use
You agree not to use the Service:
In violation of any applicable law or regulation
To harm, exploit, or endanger minors
To access data or trials you are not authorised to access
To upload malicious code or attempt to disrupt the Service
To impersonate Trialist, our staff, or other users
To misuse communications features for spam or harassment
We reserve the right to investigate and take action against misuse, including suspension or termination.
6. Intellectual Property
The Service, including its software, design, branding, and functionality (excluding User Data), is the property of Trialist or its licensors.
You may not copy, modify, distribute, or create derivative works from the Service without prior written consent.
7. Availability and Changes
We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service may be updated, modified, or temporarily unavailable due to maintenance or technical issues.
We may change or discontinue features at any time.
8. Limitation of Liability
To the maximum extent permitted by law:
The Service is provided “as is” and “as available”
Trialist is not liable for indirect, incidental, consequential, or special damages, including loss of data, revenue, or reputation
We are not responsible for decisions made based on information entered into the Service
We do not guarantee outcomes of trials, selections, or assessments
Nothing in these Terms limits liability that cannot be excluded by law.
9. Termination
We may suspend or terminate your access to the Service if:
You breach these Terms
You misuse the platform
Required payments are not made
We are legally required to do so
Upon termination, access to the Service will cease, but relevant data retention obligations may continue as described in our Privacy Policy.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
11. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
